This Writ Petition has been filed for a direction to the 7th respondent to pay the tender agreed final pending bill amount of Rs.3,92,01,666/-.

2. However, when the matter is taken up for hearing, learned counsel for the petitioner submits that subsequent to this Writ Petition, another Writ Petition has been filed before this Court in W.P.No.2673 of 2023. Hence, the petitioner may be permitted to canvass the present issue in the subsequent W.P.No.2673 of 2023 itself and he has also made an endorsement to that effect and seeks permission to withdraw this petition.

3. In view of the above, this Writ Petition stands closed with liberty to the petitioner to canvass the present issue in the subsequent Writ Petition. There shall be no order as to costs.
