Comp.A.No.198 of 2023 in C.P.No.57 of 1998 SENTHILKUMAR RAMAMOORTHY,J The property constituting the Maxworth Chokkampatti Project was brought for sale in January 2022. The applicant was the successful bidder.

Consequently, the applicant was required to pay sale consideration within a period of 30 days. The applicant requested for extension of time by filing C.A.No.48 of 2022. The said application was allowed on 26.04.2022 subject to the condition that the EMD shall stand forfeited if the balance sale consideration is not remitted within the extended period. Admittedly, the applicant defaulted in complying with the said order. Consequently, the EMD was forfeited and the property was brought for re-auction.

2. In these circumstances, the present application cannot be countenanced.

Consequently, this application is dismissed without any order as to costs.
