JUDGMENT

The learned counsel for the appellant would submit that letter sent to the appellant is returned as unserved. Death of the respondent was recorded on 24.06.2024 and the matter is posted for taking steps to bring 1/4

on record the legal representatives of the deceased respondent. Thereafter, when the matter came up on 28.02.2025, at request of the learned counsel for the appellant, the order passed is as follows: ''Steps to bring on record the legal representatives of the deceased sole respondent shall be taken on or before 10.03.2025. Failing this, the appeal shall stand dismissed automatically without any further reference to this Court.''

Thereafter also no steps have been taken in this regard within stipulated time and therefore, this Second Appeal stands dismissed for non-prosecution. No costs. Consequently, connected miscellaneous petition is closed.
