Common prayer: Petitions filed under Article 226 of the Constitution of India to issue a Writ of Prohibition in the nature of writ prohibiting the second respondent from proceeding further with the proceedings in petition No.14594/E2/2018 and pass orders.

2. The case of the petitioners is that the private respondent filed a complaint before the first respondent to issue notice to the petitioners regarding the sale deed executed by the petitioners. Challenging the same the present writ petition is filed.

3. The learned counsel for the petitioners and the private respondents would submit that the private respondent made an application before the second respondent for cancelling the sale deed executed by the petitioners. However during the pendency of the writ petition the private respondent 2/5

filed a suit in O.S.No.439 of 2019 before the Principal District Judge, Chengalpattu.

Hence prays this Court to set aside the impugned notice and issue a direction to the petitioners as well as the private respondent to adjudicate the issue before the competent Civil Court.

4. In view of the above this Court is inclined to issue a direction to the first and second respondents not to proceed further in the proceedings 14594/E2/2018 dated 12.02.2019. However the petitioners and the private respondent is at liberty to work out the remedy before the Competent civil Court where the suit is filed.

5. With the above terms, these writ petitions are disposed of. No costs. Consequently the connected miscellaneous petitions are closed. 13.10.2022 Speaking Order : Yes/ No Index : Yes/ No smn 3/5
