This application has been filed to condone the delay of 157 days in filing the application to set aside the ex-parte judgment and decree dated 29.09.2021 in the above suit.
2. Heard both sides and perused the materials available on record. 3.Though summons were served on the defendant and sufficient opportunity was given, the defendant has not filed written statement and purposefully evaded from delivery of possession. Therefore, this Court passed an ex-parte decree on 29.09.2021.
4.The reasons stated in the accompanying affidavit is not satisfactory. However, in order to give opportunity to the applicant to defend his case, this Court is inclined to allow the application on payment of costs of Rs.1,00,000/- (Rupees one lakh only). The applicant is directed to deposit Page No.1/3
the costs of Rs.1,00,000/- to the credit of the suit in C.S.No.206 of 2019 on or before 27.04.2022 before the Registry, failing which, this application shall stand automatically dismissed without further reference to this Court. 5.Post the matter on 28.04.2022 ''for reporting compliance''. 20.04.2022 ms Page No.2/3
