ORDER

The petitioner, who was arrested and remanded to judicial custody on 11.02.2026 for the alleged offences under Sections 74, 75(1) of B.N.S. read with Section 4 of TNPWH Act in Crime No.35 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner assaulted the defacto complainant with an intent to outrage her modesty and hence the case.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent, that he has not committed any offence as alleged by the prosecution, that he has been falsely implicated in this case and that he is ready to abide by any condition that may be imposed by this Court.

4. The learned Government Advocate (Criminal side) appearing for the respondent police has reiterated the prosecution case and strongly objected to enlarge the petitioner on bail. He would further submits that investigation is still pending.

5. From the submissions made by the learned Government Advocate, it appears that this is case, where the modesty of a woman has been assaulted, which has to be viewed seriously and investigation is still pending. Therefore, this Court is not inclined to enlarge the petitioner on bail.

6. Accordingly, this Criminal Original Petition is dismissed. 06-03-2026 MJS Note:
