In this contempt petition, statutory notice had already been ordered, though twice such order had been passed, the statutory notice could not have been served on the respondent. The reason being for non serving is that, the respondent had already left the country and residing in the foreign country, i.e., United Kingdom.

2. Only in that circumstances, Sub.Appl.No.727of 2018 was filed seeking permission from this Court to serve statutory notice through the Indian Embassy to the respondent, that permission was also given on 20.12.2018.

3. Despite the said permission having been given, whether any steps had been taken to serve notice to the respondent by the petitioners is not known, as no one is appearing for the petitioners.

4. In view of the said non-prosecution and the notice could not be served to the respondent, this contempt petition cannot be persuaded further. Therefore, I am of the view that, this contempt petition can be closed for the present with a liberty to the petitioners to revive this contempt petition if they 2/4

are able to find out the way to serve the notice to the respondent and in that case, they can approach this Court for revival of this contempt petition.

5. With the aforesaid observations, this Contempt Petition is closed. Consequently, connected Sub Applications are closed. 04.10.2023 NCC : Yes / No Index : Yes / No Speaking Order : Yes / No vji 3/4
