ORDER

The Criminal Original Petition has been filed seeking a direction to the Special Court for Exclusive Trial of Cases registered under SC/ST (POA) Act, Chengalpattu to consider the bail petition of the petitioner on the same day of his surrender in Crime No.12 of 2026 on the file of the second respondent police.

2.The case of the prosecution is that on 12.01.2026, when the third respondent/defacto complainant's husband and her relatives were talking in the street, the petitioner went there and abused them using their caste name. Hence, the complaint.

3.The learned Additional Public Prosecutor submitted that the petitioner and the defacto complainant were residing in the same area for quite some time knowing each other's social status. The petitioner abused and threatened the defacto complainant's husband and her relatives, who were standing in that area and asked them to move away. The petitioner also informed 2/4

that he has got some photographs of defacto complainant which he would publish in a social media and abused them using their caste name. 4.In view of the above factual position, there shall be a direction to the Special Court for Exclusive Trial of Cases registered under SC/ST (POA) Act, Chengalpattu, to consider the petitioner's bail application, preferably on the same day of his surrender, in connection with Crime No.12 of 2026 on the file of the second respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (POA) Act, 1989. The petitioner shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of receipt of a copy of this order.
