Respondents Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to impugned order of the first respondent dated 28.10.2010 made in Na.Ka.Aa1/21148/2007 whereby returning petitioner-s application for compassionate appointment and the order of second respondent dated 25.09.2012 made in Na.Ka.A3/9468/2006, in rejecting the petitioner-s application for compassionate appointment and quash the same as illegal, arbitrary, against service jurispurdence and settled principles of law and consequently direct the respondents to consider of case of petitioner and provide employment on compassionate ground.

ORDER

The prayer made in this Writ Petition is to quash the orders dated 28.10.2010 and 25.09.2012 passed by the respective respondents 1 and 2 and to direct the respondents to consider the case of the petitioner and provide employment on compassionate ground.

2.Upon notice, the second respondent filed a detailed counter affidavit, inter alia stating that the service of the petitioner-s father was not regularized as on 01.06.1995 and hence, the petitioner cannot be provided job under compassionate grounds. Thus, the orders impugned herein are correct and the same warrants no interference.

3.However, today, when this matter was taken up for consideration, the learned counsel for the petitioner, on instructions, submitted that the relief sought for herein has become infructuous and hence, nothing survives for adjudication in this writ petition.

4.In view of the above submission made by the learned counsel for the petitioner, this writ petition is dismissed as having become infructuous. No costs.
