The order passed by the Revenue Tahsildar dated 14.08.2015, rejecting the claim of the writ petitioner for grant of patta on the ground that the subject property is classified as Natham Poramboke is under challenge in the present writ petition.
2. The learned counsel for the petitioner states that the land is not correctly classified and it is not Natham Poramboke land. That part, a civil suit in O.S.No.148 of 2015 is pending before the Civil Court of Law.
3. During the pendency of the civil dispute between the parties, the revenue authorities cannot consider any application for grant of patta or its cancellation of patta or otherwise. Only after resolving the civil disputes between the parties either of the parties can submit an application for the purpose of grant of patta or cancellation of patta or otherwise. Since the Civil Suit is pending before the Civil Court of Law, the petitioner is at liberty to approach the competent authority after resolving the disputes between the parties through the Civil Court of Law and after reaching finality.
4. With this liberty, this Writ Petition stands disposed of. No costs. Consequently, connected Miscellaneous Petition is closed. 27.04.2023 Jeni Index : Yes Speaking order To The Tahsildar Cuddalore, Cuddalore Taluk, Cuddalore District.
