RESPONDENT Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Certiorarified Mandamus, calling for the records of the respondent in his communication in letter No.U.sa.Po/E and Pa/Sao/Wp/A316/18 dated 18.04.2018 and to quash the same and further direct the respondent to provide the Electricity service connection to the D.No 114 E-Block Kalyanapuram Yanaikavuni Chennai - 600003 as per the representation of the petitioner dated 16.04.2018.

O R D E R

The writ petition is directed against the impugned order, dated 18.04.2018 disconnecting the electricity service connection to the D.No 114 E-Block Kalyanapuram Yanaikavuni Chennai - 600003.

2 Counsel for the petitioner submits that Tamilnadu Slum Clearance Board allotted 114, E Block in favour of the petitioner's father in law namely S.Raji wherein the petitioner, her husband and two children are residing, after getting

electricity service connection originally stands in the name of her husband's elder brother in service connection No.107-04-499. Since he has not paid the electricity bill, the respondent disconnected the electricity service connection and subsequently, said premises was also left without any use. Petitioner's son is studying VII Standard and daughter is studying V Standard in Ariya Samaj Primary/High School, Managappan street, Chennai 600 079. Now, they are facing annual examination. Since their studies are affected for want of electricity, representation was given to the respondent on 6.3.2018 to provide electricity service connection. On receipt of the same, the impugned order has been passed and the same is liable to be quashed since the petitioner is prepared to pay the electricity charges.

3 The learned Standing counsel for the respondent submitted that the petitioner has to give an application along with Aadhar card showing the address proof of her house as Door No.114, E block, Kalyanapuram, Chennai 600 003 for which service connection No.107-004-499 was given. Therefore, the petitioner was asked to submit address proof to show that they are living in D.No.114 E block.

4 In view of the submission made by the learned Standing counsel for the respondent, without interfering with the impugned order, the petitioner is directed to approach the respondent along with necessary address and ID proof to show that the petitioner is residing in Door No.114, E Block, Kalyanapuram, Yanaikavuni, Chennai 600 063. On receipt of the same, the respondent is directed to consider the application of the petitioner and provide electricity service connection to the petitioner if it is otherwise in order.

5 The writ petition is disposed of with the above observations. No costs.
