ORDER

This Criminal Original Petition has been filed seeking direction to the 2nd respondent herein to not to harass the petitioner in the guise of an enquiry except in a manner known to law.

2. The learned counsel for the petitioner submitted that, petitioner's daughter name is Poornima Devi. One Saran Raj came with the proposal to marry the petitioner's daughter and that was taken forward. Petitioner had lent a sum of Rs.27 lakhs for developing his business, only for the reason that, his daughter is going to marry Saran Raj. Later it came to the knowledge of the petitioner that, Saran Raj was already married and has two children. Therefore, petitioner gave a complaint before the respondent and it is pending for enquiry. It appears that, Saran Raj also gave a complaint against the petitioner. On that basis, petitioner is unnecessarily harassed by the respondent police.

3. In response, learned Government Advocate (Crl. Side) submitted that, Saran Raj gave a complaint against the petitioner alleging that petitioner had cheated him to the tune of Rs.20 lakhs. After conducting enquiry, respondent police directed both the parties to work out their remedy before the competent Court. He further submitted that, there is no FIR or petition enquiry is pending against the petitioner and he is not required for enquiry. 2/4

4. Recording the submission made by the learned Government Advocate (Crl. Side) that there is no petition enquiry or FIR is pending against the petitioner and that petitioner is not required for enquiry, this Court is of the view that, no order need to be passed in this petition. Accordingly, this Criminal Original petition is disposed.
