Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the 1st respondent to dispose the petitioner's Revision dated 29.01.2019 filed for cancelling the patta issued in the name of the 4th respondent herein, in accordance with law and within a stipulated period.

ORDER

This writ petition has been filed seeking a direction to the 1st respondent to consider the petitioner's Revision dated 29.01.2019.

2. The grievance of the petitioner is that as against the order passed by the third respondent, the petitioner filed an appeal before the second respondent and the same was dismissed on 12.11.2018. Against which, he has filed a revision https://hcservices.ecourts.gov.in/hcservices/

before the first respondent on 29.01.2019. But, so far no order has been passed by the first respondent. Hence, the present writ petition has been filed.

3. The learned Government Advocate, appearing for the respondents 1 to 3, on instructions, would submit that now notice has been issued to the authorities and only because of the Covid-19, enquiry could not be conducted and the appeal will be disposed of within ten(10) days from the date of receipt of a copy of this order and he has also produced the copy of the letter sent by the first respondent.

4. Considering the facts and circumstances of the case and the fact that the petitioner's appeal, dated 12.12.2020 is pending with the first respondent, and also considering the submission made by the learned Government Advocate, without going into the merits of the case, the first respondent is directed to consider the petitioner's Revision dated 29.01.2019 and pass suitable orders on merits and in accordance with law after giving opportunity to the petitioner as well as other affected parties, within a period of four (8) weeks from the date of receipt of a copy of this order.

5. With the above directions, this Writ Petition is disposed of. No costs.
