Respondents in both CRP's COMMON PRAYER Civil Revision Petitions are filed under Article 227 of the Constitution of India seeking direction against the learned Subordinate Judge, Namakkal to expedite the proceedings in HMOP.Nos.20 & 7 of 2017 on the file of the learned Subordinate Judge, Namakkal and conclude the same within the time frame that may be fixed by this Court.
For Petitioner : Mr.E.Sathiyaraj in both CRP's COMMON O R D E R According to the revision petitioner, the revision petitioner has filed a petition HMOP.No.20 of 2017 for divorce and the respondent has filed a petition in HMOP.No.7 of 2017 for restitution of conjugal rights before the Subordinate Court, Namakkal. In the
petition filed by the revision petitioner, the respondent has not filed vakalat and the petition has been posted for filing counter affidavit. But the respondent has not chosen to file counter. Hence, the revision petitioner has filed the present Civil Revision Petitions before this Court for early disposal of the said HMOP's.
2. By considering the facts and circumstances of the case and the submissions made by the learned counsel for the revision petitioner and taking into consideration that the petitions are of the year 2017 without expressing any opinion on merits, this Court is inclined to direct the Subordinate Court, Namakkal to dispose of the HMOP.Nos.7 & 20 of 2017 in accordance with law as expeditiously as possible after providing an opportunity to the parties concerned.
3. The Civil Revision Petitions are disposed of with above direction. No costs.
