This application has been filed seeking a clarification to the effect that the names i.e., M/s.CIEL HR Services Pvt. Ltd., Ms.Hemalatha Rajan and M/s.Randstad UK Holding Ltd. are included as parties the reference to Arbitration between the applicant and the respondent.

2. Heard the learned counsel.

3.The aforesaid three parties i.e., M/s.CIEL HR Services Pvt. Ltd., Ms.Hemalatha Rajan and M/s.Randstad UK Holding Ltd. were parties in C.S.No.83 of 2016 along with the parties to the Original Petition. C.S.No.83 of 2016 was decreed on 21.11.2016 in terms of a joint memo of compromise by all the parties; O.P.No.106 of 2016 was disposed off by this Court on 25.11.2016 referring the matter to arbitration in terms of the joint memo of compromise entered into by the parties.

4. The short point is whether the three parties who were arrayed as D1, D3 & P1 in the suit are to be added as parties in the proceedings for Arbitration as well. The order of this Court dated 25.11.2016, noting the joint memo dated 20.11.2016, refers the disputes in C.S.No.83 of 2016, O.A.No.62 of 2016 as well as O.P.No.106 of 2016 to arbitration. As a consequence, the names of M/s.CIEL HR Services Pvt. Ltd., Ms.Hemalatha Rajan and M/s.Randstad UK Holding Ltd., are to be included as parties to the reference.

Order dated 25.11.2016 stands clarified to this limited extent. 09.06.2017 smi Note to Office : Registry is directed to communicate the copy of this order to the learned Arbitrator.
