Petition filed under Article 226 of the Constitution of India for the issuance of writ of mandamus directing the respondents to consider the petitioner for selection to the Post of Secondary Grade Teacher under priority Category of Destitute Widow and consequently select and appoint the petitioner to the Post of Secondary Grade Teacher based on merit in the selection under priority category.

The petitioner, after clearing Teachers Eligibility Test, submitted an application for appointment to the post of Secondary Grade Teacher. Her application was under category of Destitute Widow. Since there was no reservation for Destitute Widow, her application was not favourably considered. The petitioner submitted a representation to the Teacher Recruitment Board indicating that the Government have earmarked posts for Destitute Widows and as such, it was not open to the Teachers Recruitment Board to ignore the said Government order. The petitioner now seeks a direction to the Teachers Recruitment Board to consider and dispose of the representation.

The notification issued by the Teachers Recruitment Board does not contain any indication that posts were reserved for Destitute Widows, In the absence of a provision reserving seats for Destitute Widows, the petitioner cannot claim that she should be appointed to the post of Secondary Grade Teacher by operating the reserved list. The notification issued by the Teachers Recruitment Board is not under challenge.
3. Under such circumstances, there is no question of directing the respondents to consider the representation of the petitioner. I therefore do not find any reason to entertain this writ petition.
