The petitioner/accused in Crime No.21 of 2024 registered by the respondent police for the offences punishable under Sections 294(b), 323, 324, 302 and 506(2) of IPC seeks anticipatory bail.
2. It is stated that A1 to A4 had been arrested and they are still in judicial custody.
3. It is the case of the prosecution is that all the accused persons, were drinking and this was noticed by the defacto complainant and a quarrel arose. It is also stated that A1 had an earlier enmity with the deceased , since there was complaint about splashing of water during the construction process.
4. The learned counsel for the petitioner stated that in the 1/3
complaint, the name of the petitioner is not found.
5. However, the learned Government Advocate (Crl.Side) stated that the mother of the deceased was an eyewitness and has specifically spoken about the presence of the petitioner herein, had also joined with the other accused in assaulting the deceased, ultimately leading to the death of the deceased.
6. There was also arguments advanced about information received through Right Information Act, but, they are subjected to test of proof and reliability and therefore, I am not addressing those aspects. Since the major offence is involved under Section 302 of IPC which requires investigation, this Court is not inclined to grant anticipatory bail to the petitioner.
7. Accordingly, this Criminal Original Petition is dismissed. Vv 25.03.2024 2/3
