ORDER
(Order of the Court was made by S. NAGAMUTHU,J.,) The petitioner is the father of one V. Ragavi. Her Date of Birth is 30.08.1995. According to the petitioner, she has been found missing from 11.08.2016 onwards. In this regard, the petitioner has made to the complaint to the respondent police. Since Ms.V. Ragavi was not secured by the respondent police, the petitioner has come up with this habeas corpus petition.

Today, when this habeas corpus petition was taken up, the respondent police produced Ms.Ragavi before us. The second respondent also appeared. The second respondent is already married one Roskia and there are two children born out of the said marriage. The detenue Ragavi told us that the second respondent married her on 11.07.2016. The detenue as well as the second respondent would admit that the marriage between the second respondent and Ms.Roskia is still subsisting. Out of the sexual relationship the detenue had with the second respondent, she became pregnant and she got aborted in nine months. She told us that she is not illegally confined and she does not want to go with her parents.

We also informed that the Inspector of Police, Arumbakkam Police Station has entertained a complaint from Ms.Rosika against the second respondent, but the second respondent has not appeared before the said police for interrogation. Therefore, we direct the second respondent to appear before the Inspector of Police, Arumbakkam Police Station today at 2.00 p.m. The first respondent Inspector of Police shall lead him to Arumbakkam Police Station and cause his appearance before the Inspector of Police. The Inspector of Police, Arumbakkam Police Station shall enquire into the complaint made by Ms.Roskia against the second respondent and if any offence is made out, the Inspector of Police, Arumbakkam Police Station shall register a case and take action against the second respondent. With the above direction, this habeas corpus petition is closed giving liberty to Ms.Ragavi to decide her life on her own wish.
