O R D E R

The instant writ petition has been filed with a prayer for issuing a Mandamus directing the respondents herein to revise the wages of the petitioner with effect from 01.09.2019 based on 14th wage settlement, dated 24.08.2022 and to pay arrears of wages payable from 01.09.2019 to 31.10.2019, difference in gratuity, provident fund, leave salary and arrears of pension from 01.11.2019 to 28.02.2023 and other benefits along with the interest at the rate of 12% per annum from the date of wage settlement i.e. 24.08.2022 to within the time limit stipulated by this Court.

2. Heard the learned counsel for both sides and perused the materials available on record.

The learned counsel for the petitioner would submit that he has sent a representation dated 28.08.2023 claiming the difference amount of gratuity, provident fund, leave salary and arrears of pension from 01.11.2019 to 28.02.2023, arrears of wages and other retirement benefits along with interest, in pursuance of the 14th wage settlement, and such representation is yet to be considered by the respondents.

4. The learned Standing Counsel appearing for the respondents would fairly submit that they will consider the said representation within a reasonable time.

In view of the above submission, without going into merits of this Writ Petition, this Court deems it appropriate to direct the respondents to consider the petitioner's representation dated 28.08.2023, and pass orders on its own merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. It is made clear that if the respondents arrive at the conclusion that the petitioner is eligible for any amount, the respondents are directed to settle the amount along with interest at the rate of 6% per annum from the date of 14th wage settlement till the date 3/5

of actual disbursement of the terminal benefits to the petitioner.

6. In the result, this Writ Petition is disposed of with the above directions. No costs.
