( Civil Appellate Jurisdiction ) Tuesday, the Twentieth day of July Two Thousand Twenty One PRESENT THE HON`BLE MR JUSTICE C.V.KARTHIKEYAN CMP No.7087 of 2021 IN CRP.NO.853 OF 2020 ANBAZHAGAN [ PETITIONER ] Vs C.R.PUGALENDHI [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to permit the petitioner to withdraw the said sum of RS.2,00,000/- lying in the credit of EP No.55/18 on the file of Sub Court Jayankondam IN CMP.NO.7087 OF 2021.
Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.S.VIJAYAKUMAR, Advocate for the petitioner the court made the following order:- This application has been filed by the respondent in the revision petition/decree holder. On 26.02.2020, when the revision came up for admission, my learned predecessor had directed deposit of a sum of Rs.2,00,000/- to the credit of E.P.No.55 of 2018 before the Sub Court, Jayankondam in Ariyalur district and had granted an order of interim stay, subject to such compliance of the conditions.
2. It is informed that the said amount has been deposited. This application has been filed by the respondent in the revision petition seeking permission to withdraw the said amount. As a decree holder he is naturally entitled to such a relief.
3. The CMP is therefore allowed and permission is granted to the respondent in the revision petition/petitioner in C.M.P./Anbazhagan, son of Ayyadurai to file necessary application for withdrawal of Rs.2,00,000/- now lying to the credit of E.P.No.55 of 2018 in O.S.No.361 of 2017/Suboridinate Court https://hcservices.ecourts.gov.in/hcservices/
Jayankondam. On the filing of such an application and on examining the authenticity and identity of the decree holder, the learned Subordinate Judge may pass necessary orders permitting the withdrawal of the said amount.
