ORDER

The respondent/wife had filed a Maintenance Case in M.C.No.17 of 2013 on the file of the Judicial Magistrate, Thiruthuraipoondi and the same is pending. While so, the petitioner/husband had filed an application in I.A.No. 74 of 2014 in H.M.O.P.No.60 of 2013 on the file of the Sub-ordinate Judge, Mannargudi, seeking to send the respondent for medical test to find out whether the respondent was mentally fit for matrominal life and the same was allowed, by order dated 18.09.2014, based on the joint memo filed by both parties. The respondent alone went to the medical test and got a certificate and it was sent to the Sub-ordinate Court, Mannargudi. While so, the respondent/wife at the stage of arguments filed a petition in C.M.P. No. 3656 of 2015 under Section 311 Cr.P.C. before the Judicial Magistrate, Thiruthuraipoondi, to recall the witness to mark the medical test report, which was opposed to by the petitioner, but, the said petition was allowed on 28.04.2015. Aggrieved against the said order, this Criminal Revision Case is filed.

2. Today, when the matter is taken up, it is represented by Mr.V.Karnan, learned counsel appearing for the petitioner that already the disputed medical test report has been marked. https://hcservices.ecourts.gov.in/hcservices/

3. Having regard to the above submission, no further order is necessary at this stage. Recording the submission of the learned counsel appearing for the petitioner, this Criminal Revision Case is dismissed. Consequently, the connected Miscellaneous Petition is closed.
