ORDER

This Criminal Original Petition has been filed for direction directing the first respondent herein to execute the Non Bailable Warrant issued by the Judicial Magistrate No.II, Chengalpattu dated 05.03.2019 passed in C.C.No.6 of 2014 on 05.03.2019, against the second respondent/3rd accused, pursuant to the orders passed by this Court dated 28.04.2023 made in Crl.O.P.No.3627 of 2021.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) for the first respondent and perused the materials placed on record.

3. The petitioner filed a private complaint and the same has been taken cognizance for the offences punishable under Sections 409 and 420 of IPC as against the second respondent and two others. The second respondent is arrayed as third accused. After a period of some time, the petitioner failed to appear before the Trial Court and as such, the Trial Court had issued Non Bailable Warrant as against the second respondent and it is pending on the file of the first respondent.

4. In view of the above, the first respondent is directed to execute the

Non Bailable Warrant issued as against the second respondent in C.C.No.6 of 2014 on the file of the Judicial Magistrate Court No.II, Chengalpattu, within a period of twelve weeks from the date of receipt of a copy of this order. The petitioner is directed to furnish the correct address of the second respondent and also to co-operate while executing the Non Bailable Warrant by the first respondent herein.

5. With the above directions, this Criminal Original Petition stands disposed of.
