Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the 1st, 2nd, 3rd and 4th Respondents to take action on the Representation of the Petitioner dated 18.10.2022 in a manner known to law.

For Petitioner : Mr.A.Ganapatheeswaran For Respondents : Mr.M.Alagu Goutham, GA, for R1 to R5 : Mr.S.Senthil, for R6

O R D E R

The petitioner has filed this Writ petition seeking issuance of a Writ of Mandamus to direct the respondents 1 to 4 to take action on the petitioner's representation dated 18.10.2022.

2. Since no adverse order is being passed against the 7th respondent, notice to the 7th respondent is dispensed with.

3. The case of the petitioner is that the petitioner's daughter namely Harini completed her SSLC during the academic year 2019-2020 in the 6th respondent school. However, due to the breakdown of Covid-19, the 2/7

petitioner was unable to pay the entire tuition fees of his daughter, for which, the 6th respondent refused to issue the original SSLC Marksheet and Transfer Certificate. However, pursuant to the continuous request made by the petitioner and his daughter, the 6th respondent issued the photocopy of the Marksheet alone to the petitioner's daughter, using which, the petitioner's daughter applied for the Polytechnic course of Diploma in Computer Engineering in the 7th respondent institution. Though, the 7th respondent admitted the petitioner's daughter, however the 7th respondent directed the petitioner to provide the original SSLC Marksheet and Transfer Certificate as early as possible. Pursuant to which, the petitioner made a detailed representation dated 18.10.

2022 before the respondents 1 to 4 seeking to take action against the 6th respondent school and to direct the 6th respondent to issue the Original SSLC Marksheet and Transfer Certificate to the petitioner's daughter, enabling her to pursue with her education. However, till date no orders have been passed on the said representation and in the mean time, the 7th respondent directed the petitioner's daughter to stop attending the classes, as she was unable to produce the original certificates. Hence, the petitioner has come up with this Writ petition seeking the above relief.

4. However, pursuant to the order of this Court dated 29.03.2023, the 6th respondent / Principal appeared before this Court and produced the Transfer Certificate of the petitioner's daughter and the same was acknowledged/received by the learned counsel for the petitioner.

5. Insofar as the Original SSLC Marksheet is concerned, even the order of this Court dated 29.03.2023 reveals that, the petitioner's daughter has lost her original Marksheet. Therefore, the learned counsel for the petitioner prayed that the petitioner may be permitted to make application before the Director of Examination to obtain a duplicate copy.

6. In view of the above, this Court issues direction to the petitioner to make appropriate application before the Director of Examination within a period of two weeks from the date of receipt of a copy of this order. Upon receipt of the said application, the Director of Examination shall consider the same and issue Duplicate Marksheet to the petitioner within a period of two weeks thereafter.

7. With the above observations and directions, this Writ petition stands disposed of. No costs.
