ORDER
The criminal original petition has been filed to direct the Learned Sessions Judge Special Court for Exclusive Trial Case of SC/ST (POA) Act, Thiruvannamalai, to consider the bail application of the petitioner on the same day of his surrender in Cr.No.47 of 2026 on the file of the Respondent Police and pass such further or other orders as it may deem fit and proper in the circumstances of the case.
2.Heard the learned counsel appearing for the petitioner as well as the learned Additional Public Prosecutor appearing for the first and second respondents.
3.It is seen from the records that the petitioner/A1 in crime No.47 of 2026 had committed illicit quarrying in the property of the de facto complainant. When the same was questioned, the petitioner is said to have abused and assaulted the de facto complainant. The AR copy also confirms the assault.
4.In view of the above factual position, there shall be a direction to the the Learned Sessions Judge Special Court for Exclusive Trial Case of SC/ST (POA) Act, Thiruvannamalai, to consider the petitioner's bail application, preferably on the same day of his surrender, in connection with Crime No.47 of 2026 on the file of the second respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victim under Section 15-A of the SC/ST (PoA) Act, 1989. The petitioner shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of the receipt of a copy of this order.
