Respondents Memorandum of Grounds of Review Application filed under Order XLVII, Rule 1 read with Section 114 of the Code of Civil Procedure to review the order dated 05.02.2025 passed in W.P.No.21402 of 2023.

Mr.C.R.Malarvannan for R1

ORDER

This review application has been filed by the fifth respondent in W.P.No.21402 of 2023 to review the order dated 05.02.2025.

2. The main grievance expressed by the learned counsel for review applicant/fifth respondent is that the direction given by this Court in paragraph-9 is sought to be misread by the writ petitioner and also the official respondents as if this Court had directed the patta to be issued in favour of the writ petitioner.

3. In the considered view of this Court, the last sentence at paragraph-9 merely states that the original position has to be restored, since Patta Nos.950 & 6017 were cancelled. This only means that whatever revenue entry was available in the record before the issuance of Patta Nos.950 & 6017 has to be restored. This Court never meant that patta will automatically come in favour of the writ petitioner or in the name of any particular person. This clarification will sufficiently take care of the grievance expressed by the review applicant.

4. This Court has also made it clear that as and when the private

respondent in the writ petition move an application before the Revenue Divisional Officer, Coimbatore, it will be acted upon and the final order will be passed only after hearing all the interested persons concerned. This also sufficiently takes care of the grievance of the review applicant.

5. In the result, this review application is disposed of in the above terms. No costs.
