ORDER : The Court Made the following order :- The petitioner herein, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294 (b), 323 & 506(ii) of IPC, in Crime No.203 of 2022, on the file of the respondent police, seeks anticipatory bail.
2. The petitioner herein is an absconding accused, in which, the de facto complainant was attacked by this petitioner and other accused after picking quarrel with the mother-in-law of this petitioner. The de facto complainant sustained injuries all over his body and found on the spot and he was taken to the hospital by his wife next day after the date of occurrence. The de facto complainant was in the hospital for two days and then discharged. The earlier anticipatory bail petition was dismissed on 28.03.2022 on the ground that the victim was still in the hospital. Since the victim subsequently got discharged, the present anticipatory bail petition has been filed taking change of circumstance. https://hcservices.ecourts.gov.in/hcservices/
3. However on going through the record, this Court finds that the petitioner herein had enticed the victim to seclude the place and attacked him indiscriminately. The co-accused was arrested and later released on bail. If the anticipatory bail petition of this petitioner is entertained, there is a possibility of threat to the de facto complainant and threat to his wife.
