PRAYER in Sub Application: Sub Application filed to accept the cause title of the above Contempt Petition by permitting the impleading of the 4th and 5th respondents, being the present Commissioner and Block Development Officer of the Panchayat Union concerned and the implementing authorities of the order dated 28.02.2023 passed in W.P.No.26167 of 2015. Prayer in Contempt Petition: Contempt Petition filed under Section 11 of the Contempt of Courts Act, to punish the respondents herein for wilful disobedience of the order of this Court in W.P.No.26167 of 2015, dated 28.02.2023.

ORDER

This Sub Application is filed to implead the proposed respondents 4 and 5 in the Contempt Petition.

2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing on behalf of the respondents.

The learned counsel for the petitioner contends that this Court while disposing of the Writ Petition vide order dated 28.02.2023 in W.P.No.26167 of 2015, had directed the respondents to accommodate the petitioner in any of the forthcoming selection process, considering her education qualification and also 2/6

by granting age relaxation. The learned counsel for the petitioner further contends that as the respondents failed to comply with the aforesaid order, she has initiated contempt proceedings.

On behalf of the petitioner, it is further contended that since the proposed respondents are taking up appointment in the Panchayat Union and they also come under the third respondent in the Writ Petition, the proposed respondents may be impleaded in the present Contempt Petition which is stated to have been filed.

5. I have taken note of the respective submissions.

A perusal of the order of this Court, dated 28.02.2023 passed in W.P.No.26167 of 2015 shows that the petitioner had arrayed four respondents therein, viz., (1) the Principal Secretary, Rural Development Department, Chennai, (2) the Director, Rural Development Department, Chennai (3) The District Collector, Collectorate, Salem (4) The Commissioner, Kolathur Panchayat Union, Salem. This Court while considering the submission made at the time of disposal of the writ petition, had passed orders, directing the respondents therein to accommodate the petitioner in any of the forthcoming Selection process.

Since this Court while disposing of the above mentioned writ petition, had given a specific direction to the respondents therein, the petitioner cannot by the present Sub Application neither seek for impleadment of the proposed respondents who were not even parties to the writ petition nor claim that the proposed respondents are acting in violation of the order of this Court or wilfully disobeying of the order of this Court for which they are liable to be proceeded under the Contempt of Courts Act. Thus, the present Sub Application is filed as misconceived, and accordingly, the same is dismissed. 27-03-2026 vum Index:Yes/No Speaking/Non-speaking order 4/6
