Mr.K.Satish Kumar, learned Counsel representing for Mr.R.Vijayakumar, learned counsel for the respondent would submit that the costs has already been received and the delay of 230 days in filing application to set aside the abatement under Order 22 Rule 9 of CPC may be condoned.

2. As per the order of the Court dated 14.06.2023, the learned Counsel for the petitioner has paid a cost of Rs.2,000/- to the learned counsel for the respondent and the order of this court is complied with.

3. Consequently, Civil Miscellaneous Petition Nos.7472, 7481 and 7482 of 2023 in C.R.P.No.3997 of 2019 is allowed.
