This petition has been filed to condone the delay of 279 days in filing above Second Appeal against the Judgment and Decree dated 28.02.2019 passed in A.S.No.16 of 2015 by the Learned Subordinate Judge, Udhagamandalam which reversed the Judgment and Decree dated 10.02.2015 passed in O.S.No.89 of 2012 by the Learned District Munsif, Udhagamandalam.

2. Considering the facts and circumstances of the case, this petition is ordered subject to following condition:

"the appellant is directed to pay a sum of Rs.5000/- (Rupees Five Thousand only) as cost directly to the respondent, on or before 06.03.2023, failing which, this petition shall stand automatically dismissed.

3. On such payment, Registry is directed to number the second appeal, if it is otherwise in order.
