O R D E R

The petitioners apprehend arrest for the alleged offence under Sections 4(1)(A) and 4(C) of Tamil Nadu Prohibition (Amendment) Act, in Crime No.4 of 2026 on the file of the respondent police seek anticipatory bail. 1/4

2. The case of the prosecution is that on 02.01.2026 at about 17.15 hrs, when the respondent police were on regular patrol duty, they found the petitioners in illegal possession of 100 numbers of liquor bottles. Hence, a case has been registered against the petitioners.

3. The learned counsel appearing for the petitioners submitted that the petitioners are women and furthermore, the first petitioner among them is a senior citizen, and she may be enlarged on anticipatory bail, and the respondent police have been falsely implicated. He further submitted that A1 has already been granted regular bail. Hence, he prays to grant anticipatory bail to the petitioners.

4. Per contra, the learned Government Advocate (Crl.Side) appearing for the respondent stoutly opposed the grant of anticipatory bail to the petitioners on the ground that the petitioners have four previous cases.

5. From the submissions made by the learned counsel on either side, it is seen that the petitioners have four previous cases, which clearly shows that the petitioners have misused the liberty granted by this Court in prior points of time. In such a view of the position and taking into consideration the fact that 2/4

A1 has already been granted regular bail, that cannot be a reason to seek anticipatory bail for the petitioner herein as a matter of fact. Therefore, this Court is not desirable to enlarge the petitioners on anticipatory bail.
