ORDER

This writ petition has been filed challenging the impugned order dated 24.12.2025 passed by the 4th respondent, whereby the petitioner's application seeking for transfer of patta in her name in respect of the property more fully described in the prayer, has been rejected. 2.

The petitioner has challenged the impugned order on the ground of violation of principles of natural justice and also on the ground that it is a nonspeaking order. 3.

A perusal of the impugned order reveals that the contentions raised by the petitioner have not been considered by the 4threspondent. The impugned order merely states as follows :- "not produced the original document / attested copy" Further, the 4th respondent has failed to give due consideration of the supporting documents produced by the petitioner. It is also evident that no opportunity of personal hearing was afforded to the petitioner prior to the passing of the impugned order.

Being a non-speaking order and an order has been passed in violation of the principles of natural justice, necessarily, the impugned order

dated 24.12.2025 has to be quashed and the matter has to be remanded back to the very same respondent for fresh consideration on merits and in accordance with law.

Accordingly, the impugned order dated 24.12.2025 passed by the 4th respondent is hereby quashed and the matter is remanded back to the file of the 4th respondent for fresh consideration, on merits and in accordance with law. The petitioner shall submit a written explanation to the 4th respondent along with the supporting documents substantiating her claim for transfer of patta in her name for the subject property more fully disclosed in the prayer to the writ petition, within a period of two weeks from the date of receipt of a copy of this order.

On receipt of the said written explanation from the petitioner along with the supporting documents, the 4threspondent shall pass a final order on merits and in accordance with law, on the petitioner's application seeking for transfer of patta after giving due consideration to the written explanation submitted by the petitioner as well as the supporting documents and after hearing the objections of the necessary parties, within a period of twelve weeks thereafter. No costs. Consequently, the connected miscellaneous petitions are closed.
