ORDER

This Criminal Original Petition is filed to direct the the 1st respondent police to transfer the investigation to some other agency to register the case based on his complaint dated 06/12/2012 and to investigate the same.

2. I have heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents and I have also perused the records carefully.

4. It is represented by the learned Additional Public Prosecutor that petition enquiry is pending on the complaint given by the petitioner. He further submitted that despite summons to the petitioner, he is not appearing before the respondent police and co-operating with the enquriy. https://hcservices.ecourts.gov.in/hcservices/

5. Under such circumstances, this Criminal Original Petition is closed, giving liberty to the petitioner to appear before the respondent police for the purpose of enquiry and the respondent police is directed to expeditiously conduct enquiry and act in accordance with the law laid down by the Honourable Apex Court in Lalita Kumari vs. Govt. of U.P. & others [2013 (4) Crimes 243 (SC)].
