C.M.P.No. 7075 of 2021 in S.A. No. 113 of 2019 T.V. THAMILSELVI, J.

This petition has been filed seeking to implead proposed 2nd respondent as 2nd respondent in the above Second Appeal.

2. Today, when the matter came up for hearing, Mr.Govind Chandrasekhar, learned counsel appearing for proposed 2nd respondent would submit that he purchased the property from the 1st respondent on 26.08.2019 on execution of sale deed fraudulently during the pendency of appeal proceedings. Hence, he is a necessary party to implead him in the appeal.

3. Mr.M.Nallathambi, learned counsel for sole respondent appeared and raised formal objections in allowing this petition.

4. To avoid multiplicity of proceedings and also to adjudicate the issue fairly, this Court is inclined to allow this petition.

5. Registry is directed to carry out necessary amendment in the cause title and post the matter on 26.07.2023.
