The petitioner, who is the revision petitioner in C.A.No.77 of 2014 on the file of the Principal Sessions Judge, Krishnagiri, which has been preferred as against him in C.C.No.360 of 2013 on the file of the learned Fast Track Judicial Magistrate, Hosur, seeks suspension of his sentence of imprisonment.
2. The trial Court has recorded conviction under section 138 of the Negotiable Instruments Act and sentenced to six months simple imprisonment and directed to pay Rs.3,00,000/-, which has been confirmed by the Appellate Court, which is being challenged in this revision. Pending consideration of the revision, he seeks suspension of his sentence.
3. Heard Mr.T.Sathyamoorthy, learned counsel for the petitioner and Mr.R.Jayaprakash, learned counsel for the respondent.
4. Learned counsel for the respondent submits that there is a post event after the revision petitioner having been sent to jail pursuant to appeal judgment. Now, the cheque amount of Rs.3,00,000/- has been settled.
5. In the circumstances, ordered as under :
1. Bail granted.
2. Sentence alone is suspended.
3. He shall be released on his own bond for Rs.10,000/- (Rupees ten thousand only) to the satisfaction of the Judicial Magistrate (Fast Track), Hosur.
4. He shall appear before the Court in pursuant to the Orders of this Court, as and when so ordered by the court.
