Complainant **R2 to R5 are substituted as per order dated 10.08.2023 in Crl.M.P.No.11445 of 2023 in Crl.R.C.No.476 of 2020 Prayer:- Criminal Revision Case filed under Section 397 read with 401 of Cr.P.C, to set aside the judgment dated 05.03.2020 passed in C.A.No.51 of 2019 by the learned Principal Sessions Judge, Namakkal, confirming the judgment dated 23.09.2019 passed in C.C.No.355 of 2014 by the learned Judicial Magistrate No.I, Namakkal.

O R D E R

When the case came up for hearing, the learned Counsel for the Revision Petitioner/Accused before the Trial Court submitted that the subject matter had been amicably settled before the Mediation Centre attached to this Court.

2. Learned Counsel for the Respondents/Complainant before the Trial Court is present in Court.

3. Learned Counsel for the Respondents/Complainant submitted that earlier connected Crl.R.C.No.561 of 2020 was settled and the matter was disposed of by this Court on 15.03.2023. Further, he would submit that the Respondents/Complainant had received Rs.2,50,000/- during the mediation proceedings. Also, he submitted that the rest of the amount had been deposited before the learned Judicial Magistrate No.I, Namakkal, in the light of the settlement.

4. The learned Counsel for the Respondents/Complainant seeks permission of this Court to withdraw the amount available with the Trial 2/4

Court/learned Judicial Magistrate No.I, Namakkal.

5. This Court is inclined to dispose of the Criminal Revision Case, directing the learned Judicial Magistrate No.I, Namakkal, to permit the Complainants to withdraw the amount deposited by the Accused before the learned Judicial Magistrate No.I, Namakkal, in C.C.No.355 of 2014, dated 23.09.2019.

6. With the above direction, this Criminal Revision Case stands disposed of as settled out of Court. Consequently, connected Criminal Miscellaneous Petition is closed.
