O R D E R

Today, when the matter was taken up for hearing, the learned Senior Counsel appearing for the respondent fairly submitted that even though 120 days time has been granted by the Court below, as soon as the respondent gets money, he would pay the same to the petitioners. To show their bona fides, already on 3.7.2015, a sum of Rs.1,00,000/- has been paid, and on 8.7.2015, another sum of Rs.1,00,000/- has been paid. According to the petitioners, there is a balance of Rs.9.68 lakhs.

2. This Court has considered the submissions of both sides. The respondent has fairly undertaken to pay the entire amount even within the 120 days time limit, if he is able to mobilize funds. However, the petitioners are of the view that the arrears is a huge sum viz., Rs.9.68 lakhs. Therefore, to strike a balance between both sides, this Court directs the respondent to pay Rs.2,50,000/- (Rupees Two Lakhs and Fifty Thousand only) apart from Rs.60,000/- paid as maintenance till the balance is cleared. It is made clear that both parties shall adhere to this order and not resort to any other mode of recovery.

3. The criminal revision is disposed of accordingly. Consequently, M.P.No.1/2015 is closed.
