ORDER

(The case has been heard through video conference) The petitioner apprehends arrest at the hands of respondent police for the offence punishable under Section 8(c), 20(b)(ii)(C), 25, 29(1) of Narcotic Drugs and Psychotropic Substances Act, 1985 filed this petition and this is the second petition seeking for anticipatory bail filed by the petitioner.

2. The case of prosecution is that the petitioner along with other accused persons have transported 112 kilograms of ganja from Andhra Pradesh and the respondent police intercepted the vehicle at Vikravandi Toll and registered the case after following mandatory procedures.

3. Earlier, this Court had passed an order dated 25.02.2021 in Crl.O.P.No.3046 of 2020 dismissing the petition on the ground that the petitioner along with other accused found in possession of 112 kilograms of ganja, which is commercial quantity. Hence, the petitioner is not entitled for anticipatory bail. https://hcservices.ecourts.gov.in/hcservices/

4. Today, when the matter taken up for hearing, the learned Government Advocate appearing for respondent would submit that the petitioner is still absconding and the absconding charge sheet was also filed.

5. Considering the fact that the petitioner is still absconding and there is no change of circumstances to grant anticipatory bail to the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
