The petitioners are the legal heirs of the respondent in Second Appeal No.1341 of 2001. The sole respondent had died on 12.03.2014. However, the said death was not informed to the appellant and to the counsel for the respondent. Hence, the Court was not informed with regard to the death of the sole respondent and order was passed.

Hence, the present miscellaneous petition is filed to grant leave.

2. Considering the facts and circumstances, as noted above, leave is granted and the Judgment passed by this Court dated 26.03.2018 is recalled and the petitioners are impleaded as respondents in the second appeal to represent the respondent. Registry, is directed to list the Second Appeal before the concerned portfolio Judge for disposal and further not to place the Judgment passed by this Court, so that, the learned Judge may pass uninfluenced order.
