Mr.Yogesh Kannadasan, learned Special Government Pleader accepts notice for respondents 1 and 2. Since this writ petition is being disposed of without passing any adverse orders against respondents 3 to 8 affecting their interest, notice to those respondents is dispensed with.
2. This writ petition has been filed seeking for issuance of a writ of mandamus, directing the second respondent to dispose of the petitioner's representation dated 20.02.2024, in and by which, the petitioner sought to register the certified copy of the Judgment and Decree passed by the District Munsif Court at Chengalpattu in O.S.No.20 of 2011 dated 22.11.2019, within a time frame as may be fixed by this Court. Pg.Nos.2/6
3.The main grievance of the petitioner is that even though, he has given a representation dated 20.02.2024, till date, the second respondent has not taken any action on the said representation.
4. The learned Special Government Pleader appearing for the respondents 1 and 2 submitted that as per the prevailing practice the petitioner has to make an application through online by paying requisite fees vide E-challan, if the application is otherwise in order, token would be issued through online. However, the petitioner herein has not made the application through online. The learned Special Government Pleader further submitted that if the petitioner submits an application through online by paying requisite fees, the same would be considered by the respondents.
5. Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for respondents 1 and 2 and perused the materials available on record.
6. It is seen that the petitioner has not made the application through online, by remitting requisite fees vide e-challan, seeking to register the certified copy of the judgment and decree in O.S.No.20 of 2011. Therefore, Pg.Nos.3/6
the petitioner is directed to submit an application through online, by paying requisite fees through E-challan, within a period of one week from the date of receipt of a copy of this order. After receipt of the same, the second respondent is directed to consider the application and pass appropriate orders on merits and in accordance with law, after affording due opportunity of hearing to the petitioner as well as all the interested parties, as the case may be, within the stipulated time as stated in Circular No.R1/2005632/2022, dated 17.07.2023 issued by the Commissioner of Land Administration from the date of receipt of the online application.
