Appl.Nos.5606,5607 & 5608 of 2016 in C.S.No.605 of 2007 M.SUNDAR. J,

1. This order shall be read in conjunction with and in continuation of my earlier order dated 01.11.2016.

2. Today, when the matter is listed under the caption 'For being mentioned', at the instance of both counsel in this application, it is brought to the notice of the Court that a sum of Rs.2,68,157/- is standing to the credit of an account captioned 'the account of C.S.No.605 of 2007'.

3. It is further brought to the notice of the Court that in the prayer in the application namely Appl.No.5608 of 2016 inadvertently, a sum of Rs.1,90,750/- alone has been mentioned. The difference is owing to the interest that has accrued on the deposited amount.

4. This order which shall be read in conjunction with and continuation of earlier order will now say that a sum of Rs.2,68,157/- shall be paid out to the applicants.

5. Mr.Venkateswaran, is present on behalf of the applicants. Mr.T.S.Baskaran, is present on behalf of the sole respondent in this

M.SUNDAR, J., smi application who is the plaintiff in the main suit and the has no objection to this order being passed. Therefore, this order is being passed by consent.

6. Considering the nature of the matter, Registry is directed to issue copy of this order at the earliest and in any event on or before 12.01.2017.
