ORDER : The Court Made the following order :- This is the third anticipatory bail petition filed by the petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 417 & 420 of IPC in Crime No.1396 of 2020.

2. The case of the prosecution is that the de facto complainant was doing jewellery business at Coimbatore. One month prior to the date of occurrence, his friend Aravind's father Selvapandian informed him that gold is available with him at cheaper price. On receipt of the intimation, he made arrangements to buy two kilograms of gold for a sum of Rs.95,44,000/-. On 26.12.2020, at about 12.00 hrs, the said Selvapandian called him over phone and asked him to come to Krishnagiri along with cash. Hence he proceeded to Krishnagiri along with his driver Nagaraj in his car bearing registration No.TN-38-CE0444. In front of Saravanabhavan Hotel, Krishnagiri Bus Stand, the said Selvapandian, Anand, Sajju and Murali were standing. From there the said Selvapandian and the de facto complainant travelled in the de facto complainant's car and others came in the Tavera Car belong to Selvapandian. After reaching Aavin Junction, Anand and others got down from the car and left. Thereafter one Suresh came from Chennai https://hcservices.ecourts.gov.in/hcservices/

and joined with them. Thereafter all of them waited for the arrival of the petitioner's car.

After sometime, one car bearing registration Non.TN-04-AA-7771 Skoda Laura came there. Thereafter, the de facto complainant and the said Anand taken the money bag and boarded in the Skoda and proceeded. While on the way, one Tavera car way-laided and forcibly taken the money from them and handed over the cell phone by removing the sim card. When they try to contact the petitioner, they failed. Hence, the de facto complainant preferred a complaint before the respondent police.

3. Earlier, this Court dismissed the anticipatory bail petition filed by the petitioner in Crl.O.P.No.4420 of 2021 and Crl.O.P.No.8657 of 2021, on 22.03.2021 & 14.06.2021 respectively, considering the fact that the petitioner had bad antecedents and three previous cases pending against him.

4. Taking into consideration of the facts and circumstances of the case, and that there is no change of circumstances in this case, this Court is not inclined to grant anticipatory bail to the petitioner.
