This Criminal Original Petition has been filed for a direction to the Trial Court to dispose of the application filed by the petitioner to enforce the order of maintenance within a stipulated time frame.
2.The learned counsel for the petitioner submitted that the learned District Munsif cum Judicial Magistrate, Ranipet, has ordered maintenance to the petitioner in M.C.No.1 of 2014 and for enforcing the said order, the petitioner filed Crl.M.P.No.2337 of 2016 under Section 125(3) of Cr.PC, but the respondent has wilfully evaded service. Further the non-bailable warrant issued against the respondent is also not executed by the authorities. He also submitted that the parents of the petitioner are in a difficult position to support the petitioner for her day to day expenses. Stating so, the learned counsel prayed for the direction to enforce the order of maintenance. 3.Despite the name of the respondent printed in the cause list, there was no representation on behalf of the respondent on 21.03.2017 and to give one more opportunity, the matter has been posted today. respondent. Considering the facts and circumstances of the case, the learned District Munsif cum Judicial Magistrate, Ranipet, is directed to dispose of the petition filed by the petitioner for enforcing maintenance in Crl.M.P.No.2337 of 2016 in M.C.No.1 of 2014, pending on his file, after hearing both parties, within a period of three weeks from the date of receipt of a copy of this order.
