(CRIME NO.08/2019) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to relax the condition in "The petitioner shall appear before the Special Court for POCSO Act daily at 10.30 a.m., and 5.30 p.m., until further orders" imposed in Crl.OP.No.33604 of 2019 by an order dated 18.12.2019.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.ARUNA ELANGO, Advocate for the petitioner and of M/S. K.PRABAKAR, Additional Public Prosecutor on behalf of the Respondent the court made the following order:- Petition for relaxation of the bail condition imposed on the petitioner in Crl.OP.No.33604 of 2019, dated 18.12.2019.

2. This Court while granting bail to the petitioner imposed a condition that the petitioner shall report before the Special Court for POCSO Act daily at 10.30 a.m and 5.30 p.m until further orders.

3. The learned counsel for the petitioner would submit that the petitioner is sick and due to his constant cough, he was not allowed inside the Court and thereby, he seeks for modification of the said condition.

4.The learned Additional Public Prosecutor would submit that taking into consideration the facts of the case, this Court may direct the trial Court to complete the trial within a period of six months and also direct the petitioner to appear before the trial Court every day at 10.30 a.m. on all working days. https://hcservices.ecourts.gov.in/hcservices/

5. Taking into consideration of the fact that the petitioner is sick and that the condition imposed by this Court is suspended till 15.04.2020 and thereafter, the petitioner is directed to report before the trial Court on all hearing dates.
