PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the respondent to give a No Objection Certificate and transfer the patta of the land to the petitioner for acquisition of land made by the respondent situated at Survey No. 518/1B measuring 1,200 Sq, ft. of Hosur Village based on the payment of scrutiny fee dated 24.11.2020 and by considering the petitioner's representation dated 05.11.2025.

ORDER

This is a petition filed by the petitioner seeking a direction to the respondent to consider his representation dated 05.11.2025 for giving a no objection certificate and transfer the patta of the land to the petitioner for acquisition of land made by the respondent in respect of survey No. 518/1B measuring 1,200 sq.ft., Hosur Village based on payment of security fee dated 24.11.2020.

2. Heard the learned counsel for the petitioner and the learned Standing Counsel accepting notice for the respondent.

3. The case of the petitioner is as follows:

(i) Originally, the lands in S.Nos.517 & 518/1B were originally acquired by the respondent vide G.O.Ms.No.137 dated 30.1.1991 and at the instance of the then land owners, by order dated 21.8.2013 in W.P.No. 19701 of 2008, this Court quashed the acquisition proceedings and directed restitution of the lands involved to the respective original owners

thereby extinguishing the claim of the respondent. (ii) Later, the vendor of the petitioner filed W.P.No.19391 of 2014 seeking a direction to the respondents therein to dispose of his representation dated 20.3.2014 regarding issuance of patta in his favour for the lands in S.No.517 measuring 2.62 acres and S.No.518/1B measuring 2.42 acres, Hosur Village & Taluk, Krishnagiri District. This writ petition was disposed of on 22.7.2014 by directing the respondents therein to consider the said representation dated 20.3.2014 within a stipulated time. Pursuant to that, vide letter dated 19.9.2018, the Principal Secretary to Government of Tamil Nadu, Housing & Urban Development Department directed the respondent to issue a no objection certificate in respect of the said lands.

(iii) The petitioner acquired the subject property by way of a sale deed 04.7.2019 registered as doc.No.11735 of 2019 on the file of the SubRegistrar, Hosur. Ever since the date of purchase, the petitioner was in possession and enjoyment of the subject property. Despite repeated requests and the representation dated 05.11.2025 to the respondent, the no objection certificate is yet to be issued, which constrained the petitioner to

approach this Court with the above prayer.

Considering the limited nature of the prayer sought for and without expressing any opinion on the merits of the case, the writ petition is disposed of with a direction to the respondent to consider the petitioner's representation dated 05.11.2025 on merits and pass appropriate orders thereon in accordance with law within a period of six weeks from the date of receipt of a copy of this order.
