Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to permit the petitioner to retire from service in the post of Village Secretary and give employment to petitioner Wife K.Chitra in the light of G.O.Ms.No.10, Labour and Employment Department, dated 13.02.2009 by considering the representation dated 18.03.2021. Mr.R.Govindasamy, learned Special Government Pleader takes notice on behalf of the respondents. By consent, the writ petition is taken up for final disposal.

2.The petitioner is working as a Village Secretary. He developed high risk diabetics and afflicted with 60% disability in vision and he is not in a position to work under the respondents. Therefore, he made a request to the respondents to retire him service and appoint his wife on compassionate ground. The respondents have neither permitted him to retire from https://hcservices.ecourts.gov.in/hcservices/

service nor had given alternate employment and also not considered his representation for compassionate appointment in favour of his wife. Apart from this, he was not paid salary for the past six months. Aggrieved over the same, the petitioner is before this Court.

3.Considering the facts and circumstances of the case, instead of going into the merits of the matter, this Court consider it suffice to direct the respondents to pass orders on the representation made by the petitioner dated 18.03.2021, within a period of four weeks from the date of receipt of a copy of this order. The respondents are directed to consider the totality of the circumstances and pass orders, in the light of G.O.Ms.No.10, Labour and Employment Department, dated 13.02.2009, within the time specified by this court. 4.The Writ Petition is disposed of accordingly. No costs.
