6. L.Aruna ... Respondents Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the 1st respondent to prohibit the present office bearers of the "Anugraha Satellite Township Residents Welfare Association" to do the day to day affairs till the final disposal of the enquiry initiated by the 1st respondent herein vide No.38528/11/2018 dated 06.02.2019.

For Petitioner : Mr.S.Kumara Devan For Respondents: Mr.P.P.Purushothaman Government Advocate for R1 to R3

O R D E R

Mr.P.P.Purushothaman, learned Government Advocate takes notice for the respondents 1 to 3. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.

2. The petitioner seeks for a Mandamus, directing the 1st respondent to prohibit the present office bearers of the "Anugraha Satellite Township Residents Welfare Association" to do the day to day affairs till the final disposal of the enquiry initiated by the 1st respondent herein vide No.38528/11/2018 dated 06.02.2019.

3. Heard the learned counsel appearing for the petitioner and perused the materials placed before this Court.

4. It appears that the petitioner has already approached this Court and filed a writ petition in W.P.No.28412 of 2018, seeking for a Mandamus, directing the very same 1st respondent herein to initiate departmental proceedings as against the 2nd respondent and his associates based upon the petitioner's representation dated 21.08.2018. It is seen that the said writ petition was disposed of on 03.12.2018, directing the 1st respondent herein to consider the petitioner's representation dated 21.08.2018 and pass appropriate orders on the same on merits and in accordance with law, after issuing notice and also affording due an opportunity of hearing to the petitioner, the respondents 4 and 5 therein who are the respondents 4 and 5 herein and other interested parties, if any. It is further seen that in pursuant to the said order passed by this Court, the 1st respondent is holding an enquiry and the enquiry is still pending. Under such circumstances, the present writ petition is filed by the petitioner as stated supra.

5. I do not think that the petitioner is entitled to file one more writ petition, when already this Court has directed the 1st respondent to consider the representation of the petitioner and pass orders on the same, after hearing the petitioner and the respondents 4 and 5 herein as well. This Court finds that the present writ petition is totally unwarranted and would only lead to multiplicity of proceedings.

7. Accordingly, this Writ Petition is disposed of, only by directing the petitioner to work out his remedy before the 1st respondent in respect of the subject matter in issue which is already pending before him by way of enquiry in pursuant to the

order passed by this Court, as stated supra. No costs. Consequently, connected miscellaneous petition is closed. Sd/- Assistant Registrar(CCC) //True Copy// Sub Assistant Registrar sni/vsi To
