PRAYER : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to transfer the investigation in Crime No.266 of 2023 pending on the file of 2nd respondent to any other competent authority and to file a final report within a stipulated time.

This Criminal original petition has been filed seeking for transfer of investigation in Crime No.266 of 2023 pending on the file of 2nd respondent. 2.

When the matter was taken up for hearing, the learned Additional Public Prosecutor appearing on behalf of respondents on instructions submitted that the investigation is almost complete and the draft final report is ready and the same will be filed before the concerned Court within a period of four weeks. 3.

The learned counsel for the petitioner submitted that the investigation has been conducted in a slipshod manner and the entire attempt seems to be to cover up the misdeeds of one of the accused person who happens to be a police personnel. The learned counsel for the petitioner submitted that this person is working in the same police station where the investigation is pending. 4.

Considering the fact that the investigation is complete, there shall be a direction to the 2nd respondent to file a final report before the concerned court within a period of four weeks from the date of receipt of a copy of this order. On receipt of the final report, the Court below is directed to apply its mind and see if 2/4

proper investigation has been done in this case, considering the nature of allegation that has been made by the petitioner before taking cognizance of the final report. If ultimately, the investigation is not up to mark, it is always left open to the petitioner to revive the claim seeking for further investigation by a different agency.
