DATED: 07.06.2022

CORAM:

THE HON'BLE MR.JUSTICE M.DHANDAPANI W.P.No.12406 of 2022 K.Vidhya ...Petitioner Vs.

1. The District Collector, Dharmapuri District.

2. The District Revenue Officer, Dharmapuri District.

3. The Zonal Deputy Tahsildar, Dharmapuri District.

4. The Village Administrative Officer, Kondakarahalli Village, Dharmapuri District. ...Respondents PRAYER:Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus or any other appropriate writ or order or direction or any other writ in nature of a Writ of Mandamus directing the 3rd respondent to dispose of the petitioner's review application dated 12.01.2022 on merits. For Petitioner : M/s.Krishnasamy Chinnasamy For Respondents : Mr. Yogesh Kannadasan, Special Government Pleader.

ORDER

The present petition has been filed seeking a direction to the 3rd Respondent to dispose of the review application dated 12.01.2022 made by the petitioner on merits.

2. Mr. Yogesh Kannadasan, learned Special Government Pleader takes notice for respondents.

3. It is the case of the petitioner that the subject property is the ancestral property and the said property was shared among the legal heirs of the petitioner's grand father namely Periyappan. However, the property to an extent of about 1 hectare devolved upon the petitioner's mother, who is the legal heir of said Periyappan. In order to make corrections in the revenue records with respect to the subject property of the petitioner's mother, the petitioner made a representation dated 28.12.2021 to the 3rd Respondent, however, the same was rejected. Aggrieved by the same, the petitioner filed a review application dated 12.01.2022 for making corrections in the revenue records, before the 2nd Respondent. However, till date, the same has not been considered. Hence, the present petition has been filed.

4. Though very many grounds have been raised, learned counsel for the petitioner submits that it would suffice if this Court directs the 2nd Respondent to consider the review application made by the petitioner and dispose of the same on merits, within the time that may be stipulated by this Court.

5. On the above contention, heard the learned Additional Government Pleader appearing for the respondents.

6. In view of the aforesaid submissions, this Court, without expressing any opinion on the merits of the case, directs the 2nd Respondent to consider the review application of the petitioner and dispose of the same on merits, after affording an opportunity of personal hearing to the petitioner as well as the aggrieved persons if any, within a period of twelve weeks from the date of receipt of a copy of this order.

7. Accordingly, this writ petition is disposed of with the aforesaid direction. No costs.
