PRAYER:

Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, or any other writ of order or direction in the nature of writ, directing the first respondent to dispose of the representation of the petitioners dated 27.12.2016 in the light of D.O. Letter of the second respondent dated 31.05.2017 vide D.O. Letter No.62429/R3/2014.

O R D E R

The relief sought for a direction to consider the representation submitted by the writ petitioners on 27.12.2016.

2. The learned counsel appearing for the writ petitioners contended that the claim of promotion set out in the writ petition is based on D.O. Letter of the second respondent, dated 31.05.2017, and accordingly, the writ petitioners are eligible for promotion to the further higher cadre. The respondents have not considered the same in accordance with rules and the representation submitted in this regard was also not considered by the respondents.

3. Thus, without going into merits and demerits of the matter, the first respondent is directed to consider the representation submitted by the writ petitioners on 27.12.2016 and pass orders on merits in accordance with law within twelve weeks from the date of receipt of a copy of this order.

4. With the above direction the writ petition stands disposed of. However, no order as to costs.
