ORDER
The petitioner, who was arrested and remanded to judicial custody on 10.02.2026 for the alleged offences under Sections 296(b), 115(2), 118(1),
329(4), 351(3) and 109 of B.N.S. in Crime No.28 of 2026 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that on 09.02.2026 at about 8 pm., the petitioner picked wordy quarrel with the defacto complainant and assaulted him with deadly weapon. Hence, this case.
3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent, that according to the prosecution, the petitioner attacked the victim with deadly weapon, due to which, the victim sustained injury. The injured person was discharged from the hospital. He would further submit that the petitioner has been falsely implicated in this case. Therefore, he prays to enlarge the petitioner on bail.

Whereas the learned Government Advocate (Criminal side) appearing for the respondent police strongly opposed to enlarge the petitioner on bail on the sole ground that the petitioner has 5 other previous cases and investigation is still pending. He further submits that the prosecution requires the petitioner for completing the investigation and if the petitioner is enlarged on bail, there is every possibility for tampering of witnesses.
5. While looking at the very submission made by the learned Government Advocate that investigation is still pending as the petitioner is under judicial custody only from 10.02.2026. this Court is of the opinion that it is not desirable to enlarge the petitioner on bail at this point of time.
6. Accordingly, this Criminal Original Petition is dismissed. 05-03-2026 MJS Note:
